1. Acceptance of Terms & Binding Agreement

This Terms of Service agreement ("Agreement") constitutes a legally binding contract between you ("User", "you", or "your") and the operators, owners, administrators, moderators, and staff ("Staff", "we", "us", or "our") governing your access to and use of Stunod Racing, Stewie Racing, all subdomains, software, community forums, message boards, file resource managers, download repositories, and associated infrastructure (collectively, the "Service").

By accessing, browsing, registering for, uploading to, downloading from, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by all terms, conditions, policies, and disclaimers contained herein. If you do not agree with any portion of this Agreement, you are strictly prohibited from using or accessing the Service and must terminate your session immediately.

2. Eligibility & Account Security

• Age Requirements: You must be at least seventeen (17) years of age to access or register for an account on this Service. By registering, you represent and warrant that you meet this minimum age requirement.
• Single Account Policy: You are permitted to register and maintain exactly one (1) account per natural person. Creating secondary accounts ("alt accounts"), using disposable email services, or employing virtual private networks (VPNs), proxies, or automated methods to evade account bans or registration limits is strictly prohibited and constitutes a material breach of this Agreement.
• Account Credential Security: You are solely responsible for maintaining the confidentiality of your account username, password, and session access. You agree not to disclose your password to any third party or allow any other person to access your account. You accept sole legal and financial responsibility for all activities, posts, uploads, and interactions that occur under your account credentials.
• Accuracy of Account Data: You agree to provide accurate, current, and complete information during registration and to maintain the cleanliness and accuracy of your public profile. We reserve the right to edit or delete any profile information deemed inaccurate, impersonating, offensive, or vulgar without prior notice.

3. Staff Authority, Moderation & Liability Waiver

The Service is operated by volunteer and professional Staff who perform moderation, administrative, and system upkeep duties in good faith.

• Staff Moderation Immunity: You acknowledge and agree that Staff members act as administrators and moderators of the platform only. Staff members, both individually and collectively, shall be held completely free from civil liability, claims, or demands arising out of any official actions taken on the Service, including but not limited to: editing, deleting, moving, or locking threads/posts; suspending, banning, or terminating user accounts; removing uploaded download assets; or issuing administrative notices.
• No Obligation to Monitor: You acknowledge that Staff cannot and do not actively prescreen, monitor, or continuously review every message, file, or piece of content posted to the Service. The views expressed in posts, resources, or files belong solely to the individual authors and do not reflect the opinions, policies, or endorsements of the Staff, owners, or site affiliates.
• Absolute Right to Terminate Access: We reserve the right, in our sole and absolute discretion, to modify, refuse, move, soft-delete, hard-delete, or permanently strip any Content or file from the Service, and to restrict, suspend, or terminate access for any user at any time, for any reason or no reason, with or without prior notice, and without financial or legal liability to you.
• Interpersonal Disputes: Staff are under no obligation to resolve, mediate, or become involved in personal conflicts, disputes, or arguments between members. Users are expected to utilize built-in blocking and ignore functions.

4. User-Generated Content & File Resource Repository

The Service provides forums and file repositories allowing users to share original or modified digital assets, including but not limited to 3D car models, templates, track files, paint schemes, setup configurations, graphics, scripts, and software tools ("User Assets").

• Copyright & Ownership Warranties: You retain ownership of your original intellectual property. However, by uploading, submitting, or linking any Content or User Asset to the Service, you explicitly warrant and represent that:
  1. You are the sole creator and owner of the material, or you possess clear, explicit, written authorization from the copyright holder to distribute the material on our Service.
  2. The material does not infringe upon any third-party trademark, patent, trade secret, copyright, privacy right, or proprietary right.
• Irrevocable Worldwide Hosting License: By submitting Content or User Assets to any part of the Service, you grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable, sublicensable license to host, store, cache, reproduce, distribute, display, transmit, reformat, and publish such material across all current and future infrastructure associated with operating, promoting, and maintaining the Service. This license survives account termination or voluntary user departure.
• Modifications and File Updates: You grant us the right to alter file compression formats, generate screenshots/thumbnails, append archive notices, or remove corrupt/outdated file attachments as necessary to maintain repository integrity and server health.

5. Download Disclaimer & User Assumption of Risk

READ THIS SECTION CAREFULLY: ALL DOWNLOADS ARE AT YOUR OWN RISK.

• "AS-IS" Download Files: All downloadable files, archives, templates, graphics, and tools available through the Service are uploaded by third-party community members. WE DO NOT GUARANTEE, WARRANT, OR VERIFY THE SAFETY, FUNCTIONALITY, ACCURACY, OR INTEGRITY OF ANY USER ASSET.
• No Liability for Damage or Data Loss: Under no circumstances shall the Staff, site owners, or operators be held liable for any direct, indirect, incidental, consequential, or punitive damage resulting from downloading, installing, running, or executing files retrieved from the Service. This includes, but is not limited to: system crashes, operating system failure, software corruption, game installation corruption, loss of saved game data, hardware damage, or infection by viruses, trojans, spyware, or malicious code.
• User Responsibility to Scan: It is your sole responsibility to execute up-to-date antivirus, anti-malware, and security scans on all downloaded archives prior to opening or installing them.

6. Prohibited Conduct & Anti-Abuse Policies

You agree that you will strictly abide by all community standards and will NEVER use the Service to:

1. Submit Illegal or Harmful Material: Post, upload, transmit, or distribute any content that is unlawful, defamatory, abusive, harassing, stalker-like, vulgar, obscene, sexually explicit, hateful, threatening, invasive of another's privacy, or encouraging criminal activity.
2. Upload Malicious Code: Upload or link to any file containing software viruses, worms, trojans, ransomware, keyloggers, backdoors, or any code designed to disrupt, damage, or limit the functionality of computer hardware or telecommunications equipment.
3. Violate Intellectual Property: Distribute pirated software, cracked video game executables, paid third-party assets without authorization, or copyrighted materials owned by commercial entities or independent creators.
4. Automated Scraping & Bot Exploitation: Access, index, scrape, aggregate, or download content or download repository files via automated scripts, web crawlers, spiders, bots, offline readers, or programmatic scrapers without our express written consent.
5. Infrastructure Abuse & Denial of Service: Engage in any activity that imposes an unreasonable or disproportionately large load on our servers, databases, bandwidth, or network infrastructure. This includes launch of flooding attacks, distributed denial-of-service (DDoS) attempts, mass-request generation, or intentionally triggering costly database operations.
6. Commercial Spamming: Publish unsolicited commercial advertisements, affiliate marketing links, referral links, spam, chain letters, pyramid schemes, or unauthorized business solicitations.

7. DMCA & Copyright Infringement Takedown Policy

We respect the intellectual property rights of others and comply with the safe harbor provisions of the Digital Millennium Copyright Act (DMCA) / 17 U.S.C. § 512.

If you believe that your copyrighted work has been uploaded or linked on the Service in a manner that constitutes copyright infringement, you must submit a written DMCA Takedown Notice to our designated contact interface containing the following details:

• A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
• A clear description of the copyrighted work claimed to have been infringed.
• The exact URL, thread link, or file resource location where the allegedly infringing material is located on our Service.
• Your full contact details, including full name, mailing address, telephone number, and email address.
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

8. Disclaimer of Warranties

THE SERVICE, INCLUDING ALL CONTENT, FORUMS, DOWNLOAD REPOSITORIES, AND USER ASSETS, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE STAFF AND OWNERS EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, AND UNINTERRUPTED UPTIME. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, FREE OF VIRUSES OR HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Comprehensive Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OWNERS, OPERATORS, VOLUNTEER STAFF, MODERATORS, ADMINISTRATORS, DOMAIN REGISTRANTS, OR HOSTING AFFILIATES OF THIS SERVICE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, HARDWARE FAILURE, SYSTEM DAMAGE, COST OF COVER, OR REPUTATIONAL HARM) ARISING OUT OF OR IN CONNECTION WITH:

• YOUR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE OR ANY DOWNLOADABLE FILES.
• ANY CONDUCT, STATEMENTS, POSTS, OR CONTENT SUBMITTED BY THIRD PARTIES OR OTHER USERS ON THE SERVICE.
• MODERATION ACTIONS, ACCOUNT SUSPENSIONS, OR CONTENT DELETIONS EXECUTED BY STAFF MEMBERS.
• UNAUTHORIZED ACCESS, ALTERATION, OR LEAK OF YOUR TRANSMISSIONS, PROFILE DATA, OR TECHNICAL INFORMATION.
• SERVER DOWNTIME, HOSTING OUTAGES, DATABASE CORRUPTION, OR FINANCIAL LIABILITIES INCURRED THROUGH NETWORK ATTACKS.

10. User Indemnification

You agree to defend, indemnify, hold harmless, and release the site owners, operators, administrators, moderators, volunteer staff, and hosting providers from and against any and all claims, demands, liabilities, damages, losses, judgments, costs, and expenses (including reasonable attorney fees and court costs) arising out of or related to:

• Your breach or violation of any provision contained within this Agreement.
• Your submission, publication, or distribution of any User Assets, posts, or content that violates third-party copyright, trademark, trade secret, privacy, or legal rights.
• Your use or misuse of the Service or any files downloaded from the platform.
• Any unauthorized bot activity, automated request flooding, or network interference originated from your account or IP address.

11. Technical Data, Privacy & IP Logging

• IP Address Tracking: For security auditing, bot prevention, server load management, and ban enforcement, technical data—including your IP address, browser user-agent, and activity timestamps—is recorded on every post, request, account creation, and file download.
• Cooperation with Law Enforcement: We reserve the right to disclose user identifiers, IP logs, and system data to legal authorities or legal counsel in response to subpoenas, court orders, formal legal investigations, or to protect the safety and property of our Service, Staff, or the public.
• Session Cookies: The Service utilizes standard HTTP cookies to store authentication tokens, keep you logged in, and maintain display preferences.

12. Severability, Governing Law & Updates

• Severability: If any provision or clause of this Agreement is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
• Modifications without Prior Notice: We reserve the right to revise, update, or overhaul this Agreement at any time without individual direct notice. Revised terms become effective immediately upon posting to the Service. Your continued use of the platform after updates are posted constitutes binding acceptance of the new terms.
• Account Closure & Legal Notices: If you do not accept these terms, you must cease using the Service immediately. To request account deactivation or deliver legal notices, please contact site administration via the designated contact interface.
